Peter Burke Electrical Ltd (P.B.E.) Terms & Conditions – Electrical Quotation

1. Introduction & Definitions
a. Definitions:

“P.B.E.” or “We/Us”: Refers to Peter Burke Electrical Ltd, a limited company registered in the Republic of Ireland, offering electrical contracting services in accordance with Irish regulations.

“Client” or “You”: Refers to the individual, business, or organisation engaging P.B.E. to carry out electrical works as outlined in an official quotation.

“Quotation”: A written, itemised estimate provided by P.B.E. that outlines the proposed Works, Materials, labour, timelines, and costs.

“Works”: All services provided by P.B.E. as outlined in the Quotation, including installation, testing, maintenance, inspection, repair, and commissioning of electrical systems or related infrastructure.

“Site”: The location(s) specified for the execution of Works, whether residential, commercial, industrial, or otherwise.

“Materials”: Electrical goods, components, cables, fixtures, systems, and any associated consumables supplied by P.B.E.

“Second Fix Materials”: Final-stage fittings such as sockets, light switches, faceplates, and other visible electrical accessories.

“Completion”: The point at which the Works have been substantially carried out and are considered finished by P.B.E., except for agreed minor adjustments or snagging.

“Certification”: Refers to the completion or installation certificate issued under Safe Electric / RECI upon satisfactory completion and inspection of the Works.
b. Acceptance of Terms:
Engaging P.B.E. for any form of service or accepting a Quotation constitutes full legal acceptance of these Terms and Conditions. The Client confirms they have reviewed, understood, and accepted these terms. These Terms, once accepted, form the basis of a binding contract. The latest version is publicly available at www.pbe.ie.
c. Quotation Validity and Pricing Adjustments:
All Quotations are valid for 30 calendar days from the issue date. Prices are based on prevailing labour rates and material costs at the time of quoting. P.B.E. reserves the right to amend pricing due to fluctuations in supply costs, availability, or changes in project scope. Removal of any item from a quotation may affect system compatibility, regulatory compliance, or sequencing, and may result in a revised Quotation.
d. Scope, Instructions & Amendments:
All changes to the agreed scope of Works must be made in writing and submitted directly to Peter Burke. Instructions relayed to or by site personnel, subcontractors, or third parties without prior written approval are not valid. Verbal discussions must be confirmed in writing to ensure contractual clarity.
2. Project Execution & Site Management
a. Access to Site & Preparation:
The Client must provide unrestricted, safe access to the Site during working hours. Delays due to inaccessible work areas, third-party obstructions, or incomplete preparation will be charged at the current hourly rate. Power, water, and toilet facilities must be made available unless otherwise agreed.
b. Protection of Client Property:
While P.B.E. exercises care during the execution of Works, we are not liable for incidental cosmetic damage (e.g., paint scratches, cracked plaster, dust) resulting from necessary tasks such as chasing, drilling, or lifting floorboards. The Client is advised to cover or remove valuable furniture and décor.
c. Plastering & Finishing:
Unless specified in the Quotation, plastering, painting, tiling, and other decorative work are excluded and should be arranged by the Client.
d. Equipment Placement & Relocation Requests:
Where no placement details are provided by the Client, P.B.E. will use its professional discretion. Relocation of installed equipment or fittings due to a change of mind will incur an additional labour and material fee.
e. Unforeseen Conditions & Variations:
In the event that hidden issues (e.g., faulty wiring, damp, asbestos, outdated installations) are discovered during the Works, these will be communicated immediately. Any required corrective work will be subject to a written Variation Order and billed separately.
f. Client-Supplied Products:
All Client-supplied materials or fittings must meet Irish and EU safety standards. P.B.E. reserves the right to reject installation of incompatible or substandard products. No warranty applies to Client-supplied items, and any delays or failures arising from their use remain the Client’s responsibility.
g. Standard Second Fix Materials:
Unless otherwise requested, white PVC fittings will be used for second fix components. Upgrades or specific brand/style preferences must be confirmed in advance and may incur additional charges.
h. Third-Party Delays:
P.B.E. is not responsible for delays or disruption caused by other trades, contractors, or suppliers. The Client must coordinate access and scheduling with all relevant parties.
i. External Labour or Contractors:
If the Client hires additional labour, P.B.E. is not responsible for their work, safety compliance, or quality control. All subcontractors engaged directly by the Client operate independently.
j. Working at Height:
Where ladders, scaffolding, or powered access platforms are required, responsibility for arranging and funding such equipment lies with the Client unless otherwise agreed in writing.
3. Health, Safety & Technical Standards
a. Health & Safety Compliance:
All Works shall be executed in accordance with the Safety, Health and Welfare at Work Act 2005, including all relevant amendments and codes of practice. The Client must notify P.B.E. of any Site-specific hazards or restrictions prior to commencement.
b. Technical & Regulatory Compliance:
All installations will comply with the National Rules for Electrical Installations – I.S. 10101 and applicable Irish and EU standards. This includes correct circuit sizing, earthing, bonding, and protective devices.
c. Arc Fault Detection Devices (AFDDs):
These devices enhance safety but are not included unless expressly quoted. Their use is recommended for high-risk circuits (e.g., bedrooms, timber-structure buildings).
d. Dedicated Circuitry:
It is best practice to provide separate circuits for high-powered appliances such as ovens, EV chargers, or immersion heaters. These will be included in the Quotation where applicable.
4. Financial Terms & Payments
a. Payment Schedule:

Deposit (50%): Payable upon Quotation acceptance.

Second Fix Invoice (45%): Due upon completion of second fix.

Final Payment (5%): Due on Completion of all Works.
Power will not be energised, and no Completion Certification will be issued until the second invoice is paid in full.
b. Retention of Ownership:
All Materials remain the property of P.B.E. until full payment is received. P.B.E. reserves the right to remove unfixed goods or fittings in the event of non-payment.
c. Out-of-Hours & Emergency Work:
Any works performed outside of standard business hours (Mon–Fri, 8am–5pm) or under emergency conditions are subject to premium rates.
d. Cancellations & Rescheduling:
In the event of cancellation after acceptance, the Client is liable for all costs incurred to date, including Materials ordered, labour undertaken, administration time, and any loss of scheduled work. A formal written notice must be provided for cancellations or major delays.
5. Post-Completion, Warranty & Maintenance
a. Snagging Period & Workmanship Guarantee:
Clients have up to 10 weeks following Second Fix Completion to submit a snag list. P.B.E. provides a 12-month warranty on workmanship from the date of Completion. This warranty excludes:

Misuse or damage by the Client or third parties

Wear and tear

Damage caused by flooding, fire, rodents, pests, or external events

Failure of Client-supplied products
b. Ongoing Maintenance & Additional Services:
Routine maintenance, testing, or future servicing are not included in the original Quotation but can be arranged as separate works with a new estimate.
6. General Provisions
a. Meetings & Correspondence:
Up to five site or design meetings are included in the scope. Additional meetings or consultations will be billed separately. P.B.E. can be contacted via phone, text, email, or WhatsApp during standard business hours.
b. Photography & Documentation:
Photographs taken during the project may be used for training, documentation, or marketing purposes. No personally identifiable data will be published without the Client’s written consent.
c. Temporary Site Documentation:
Signage, drawings, safety notices, and other documentation may be temporarily displayed on-site to comply with safety or quality management protocols.
d. Client Sign-Off:
Upon Completion, P.B.E. may request a written sign-off to confirm satisfaction with the completed Works. This does not affect the Client’s rights under warranty.
e. Liability & Damage:
While every effort is made to avoid damage, P.B.E. is not liable for minor disruptions caused by the nature of electrical works. Maximum liability is limited to the value of the Quotation. Clients are advised to ensure they have suitable home or site insurance.
f. Force Majeure:
P.B.E. is not responsible for any delays or non-performance due to factors beyond its control, including but not limited to extreme weather, material shortages, industrial action, or pandemics.
g. Intellectual Property:
All designs, layouts, and plans remain the intellectual property of P.B.E. until full payment is made. Thereafter, they may be used by the Client solely for the agreed project.
h. Dispute Resolution:
In the event of a dispute, both parties agree to seek resolution via direct negotiation. If unresolved, the matter will proceed to mediation before formal legal action is considered.
i. Governing Law & Jurisdiction:
These Terms & Conditions shall be governed by and construed in accordance with the laws of Ireland. Disputes will be subject to the exclusive jurisdiction of the Irish courts.
j. Statutory Consumer Rights:
These Terms do not affect your statutory rights under Irish consumer protection law.
k. Data Protection:
P.B.E. complies with GDPR and the Data Protection Act 2018. Personal data collected will be processed solely for project, accounting, or compliance purposes.
